If you are traumatically injured in the course of your employment or sustain an occupational disease (such as carpal tunnel syndrome, occupational hearing loss or other work related conditions) you are entitled to the benefits provided by the Workers’ Compensation Act. These benefits include payments for time lost while recuperating from your injury, payment of medical expenses, payment for job retraining and the award of a lump sum of money for any permanent physical or psychological disability you may retain.
Your employer and their workers’ compensation insurance carrier will be represented by legal counsel and you should also obtain experienced legal representation in order to secure your benefits. If any legal fees are approved by the Workers’ Compensation Commission, they are subtracted from your benefits and paid directly by your employer or their workers’ compensation insurance carrier. Fees are never paid from your pocket.
You should also know that it is a crime for an employer to fire someone because they file a workers’ compensation claim. Employers are well aware of this. As a result, the filing of a claim is often your best job protection.
