David Wright To Appear Before Court of Appeals On Issues Of Job Security For Public Employees

On February 7, 2017, the Maryland Court of Appeals will hear argument in the case of Allen Tiffany v. University of Maryland, College Park – Case No. 59, September Term, 2016.  David Wright will argue on behalf of Mr. Tiffany and his union, AFSCME Maryland.   The Court shall determine two questions: whether a collective bargaining agreement that directs that an employee may only be disciplined for cause abrogates at-will employment; and, whether a right to process for a public employee abrogates at-will employment.davidwrightbio-1-w280

The issues presented are of paramount importance to both unionized employees and civil service employees who hold and desire job security subject to termination only for just cause.  Indeed, it is a hallmark of both the unionized workplace and the civil service that employees be permitted to perform their jobs without fear of arbitrary or unwarranted removal.  In this case, the Circuit Court for Baltimore City applied these principles and found exempt employees of the University of Maryland College Park subject to termination only for cause.  The Maryland Court of Special Appeals, in an unreported decision, found exempt employees could be terminated for no cause.
